-DROS is Bogged Down. We have received confirmed reports from firearms dealers and the DOJ that the California's Dealer Record of Sale (DROS) system is being heavily used which is causing a heavy delay. People who ran out to buy their first self-defense tool at the beginning of the COVID-19 outbreak are returning to pick up their firearm after their background check and 10-day wait period. The unprecedented number of purchases is exhausting the system to the point of near breakdown. This has resulted in delays in the firearms dealer's ability to release the firearm to the customer. The customer has to try multiple times and possibly come back the next day.
This is inexcusable, but it is due to incompetence and not malfeasance. State systems like unemployment are experiencing similar problems because of the unprecedented number of claims. Californians can still purchase firearms and take possession of new firearms. New gun owners and gun dealers have been successful if they are patient and persistent.
There is no expectations that this will get fixed any time soon. There is no reason to believe this was intentional or coordinated. Shops are working on ways to make things as easy as possible on customers.
-Masks and CCWs. We have confirmed with attorneys and high level of law enforcement that yes, California CCW holders can wear a medical mask designed to protect public health while legally carrying a firearm. I am not an attorney, this is not legal advice, you are responsible for understanding all applicable laws in your area.
To better explain, here is a sample letter we are sending to law enforcement agencies:
Sheriff or Police Chief,
With the newly issued order to wear masks when out in public and because CCW holders are some of the most law-abiding people in society, please formally get the word out to your staff about Penal Code 25300(a) which states:
A person commits criminal possession of a firearm when the person carries a firearm in a public place or on any public street while masked so as to hide the person’s identity. ( link to the text of the law CLICK HERE )
It is clear that someone wearing a mask to comply with a public health order is not attempting to "hide the person's identity". It could be confusing for law enforcement officers and CCW holders because the section goes on to exempt law enforcement and hunters, but not CCW holders directly. The last thing we want is for a CCW holder to not wear a mask because she is concerned with following the law. Please send an advisory memo department wide to avoid any confusions or mistakes in the field.
There is no concern with wearing a medical mask that covers your mouth and nose for the purpose of public health. Please help us squash rumor and conspiracy theory. Please continue to comply with all local COVID-19 measures in place and all laws in general; especially while legally carrying concealed with a CCW.
